Airport Noise Local Regulation

The Bragman law firm is assisting residents of the Town of East Hampton who are seeking to re-instate local control over airport access and use to control noise. Local control to limit noise is available to airport owners or proprietors like the Town of East Hampton, which do not take FAA funding for capital projects. That funding requires certain grant promises, or assurances, which relinquish local control.

Proprietor's powers of local control to limit noise are confirmed in National Helicopter Corp. of America v. City of New York, et al. (click on link to read the text of this important decision).
